

on making a charitable donation
1.1. This public offer (the “Offer”) is a proposal by CHARITY ORGANIZATION “CHARITY FUND “YELLOWBLUE FORCE UKRAINE”, EDRPOU code 45044205 (the “Fund”), represented by its Director Borys Danevych, acting under the Charter, to conclude an agreement on a charitable donation (the “Agreement”) with any legally capable individual or legal entity (the “Benefactor”) on the terms set out below.
1.2. The Offer is published on the Fund’s website https://www.yellowblue.foundation (the “Website”) and remains in effect indefinitely until revoked by the Fund.
1.3. The Offer is made in accordance with Articles 641, 644, 729, 730 of the Civil Code of Ukraine, the Law of Ukraine “On Charitable Activities and Charitable Organizations” and the Fund’s Charter, which entitles the Fund to conduct public collection of charitable donations.
2.1. The subject of the Agreement is the voluntary, gratuitous transfer of funds by the Benefactor into the ownership of the Fund as a charitable donation to support the Fund’s statutory activities.
2.2. A charitable donation is voluntary and does not entitle the Benefactor to any goods, works or services in return. The Fund is not a seller of goods or services, and a donation is not a payment for them.
2.3. Donations are used in line with the Fund’s statutory purposes, including assistance to healthcare institutions, support of hospitals’ energy resilience, aid to those affected by the armed aggression, and other purposes defined by the Charter. Where a fundraising campaign is announced for a specific purpose, donations are used primarily for that purpose; if the purpose is achieved or cannot be implemented, the Fund may allocate the remaining funds to its other statutory purposes.
2.4. A charitable donation may be one-time or recurring (monthly). The terms of recurring donations are set out in Section 4 of this Offer.
3.1. The Offer is accepted by the Benefactor transferring funds to the Fund’s account via the payment form on the Website, a payment service, or the Fund’s bank details.
3.2. The Agreement is deemed concluded from the moment the funds are credited to the Fund’s account. By making a donation, the Benefactor confirms having read, understood and fully accepted the terms of the Offer, and consents to the processing of personal data under the Privacy Policy published on the Website.
3.3. The Benefactor determines the amount of the donation independently, within the limits set by the payment service.
4.1. The Benefactor may set up a recurring charitable donation by selecting the relevant option on the Website and making the first payment. Making the first payment under a recurring donation constitutes acceptance of the terms of this Section.
4.2. Once a recurring donation is set up, the amount selected by the Benefactor is charged to the Benefactor’s payment card monthly, on the date corresponding to the date of the first payment, until the recurring donation is cancelled.
4.3. Charges are made by the payment service on the basis of the consent given by the Benefactor when setting up the recurring donation. The Fund does not store the Benefactor’s payment card details.
4.4. Notifications of each charge are sent by the payment service to the email address provided by the Benefactor when setting up the recurring donation.
4.5. The Benefactor may cancel a recurring donation at any time by sending a request to office@yellowblue.foundation. The Fund stops further charges within 5 (five) business days of receiving the request. The cancellation procedure is set out in the Refund Policy.
4.6. To change the amount or currency of a recurring donation, the Benefactor cancels the current recurring donation and sets up a new one on the preferred terms.
4.7. The Fund may discontinue accepting recurring donations by publishing a notice on the Website. Charges made before such discontinuation are used in accordance with this Offer.
5.1. The Fund undertakes to use the donations received in accordance with the laws of Ukraine, the Charter and this Offer.
5.2. The Fund publishes annual reports on its activities on the Website. The Benefactor may request information on the use of their donation by contacting the Fund at the email address specified in Section 8.
5.3. The Fund may decline a donation and return the funds to the Benefactor if their origin or the terms of their provision contradict the laws of Ukraine or the Fund’s values.
5.4. The Benefactor confirms that the funds transferred to the Fund belong to the Benefactor on lawful grounds and that the payment instrument used belongs to the Benefactor or is used lawfully.
6.1. A charitable donation is voluntary and, as a general rule, non-refundable.
6.2. The procedure for refunding erroneous payments and for cancelling recurring donations is set out in the Refund Policy published on the Website, which forms an integral part of this Offer.
7.1. By making a donation, the Benefactor consents to the processing of their personal data in accordance with the Law of Ukraine “On Personal Data Protection”, on the terms of the Privacy Policy published on the Website.
7.2. Where a recurring donation is set up, the Fund processes the Benefactor’s personal data for the entire term of the recurring donation and, after its cancellation, for the periods set out in the Privacy Policy and the laws of Ukraine.
