1. General Provisions

1.1. This Privacy Policy (the “Policy”) sets out how CHARITY ORGANIZATION “CHARITY FUND “YELLOWBLUE FORCE UKRAINE”, EDRPOU code 45044205 (the “Fund”, “we”), processes and protects personal data received from visitors and benefactors through the website https://www.yellowblue.foundation (the “Website”).

1.2. The Policy is drawn up in accordance with the Law of Ukraine “On Personal Data Protection”. The Fund is the controller of personal data.

1.3. By using the Website and providing your data, you confirm that you have read and agree to this Policy.

2. Data we process

2.1. Data you provide yourself: full name, email address, phone number – when making a donation, setting up a recurring donation, subscribing to news, or contacting the Fund via the feedback form.

2.2. Payment data: amount, currency, date and status of the payment, type of donation (one-time or recurring). The Fund receives this data from the payment service.

2.3. Technical data: IP address, browser and device type, pages of the Website you viewed – processed automatically by the Website and web analytics services.

2.4. The Fund does NOT receive or store your full payment card details. Card details are entered on the secure page of the payment service and processed exclusively by it in accordance with the PCI DSS standard.

3. Purposes of processing

3.1. Performance of the charitable donation agreement, including making and administering recurring (monthly) donations.

3.2. Sending payment confirmations, charge notifications and responses to your enquiries.

3.3. Accounting, reporting and compliance with other obligations imposed on the Fund by the laws of Ukraine.

3.4. Sending news and information about the Fund’s activities – only with your separate consent (news subscription).

4. Sharing data with third parties

4.1. The Fund does not sell or transfer your personal data to third parties, except as set out in this Policy and required by the laws of Ukraine.

4.2. Data is transferred to the payment service WayForPay, which processes the payments — to the extent necessary to complete the payment — as well as to banks, auditors and public authorities in the cases provided for by law.

4.3. To send emails, the Fund may use email delivery services that process your email address solely on the Fund’s instructions.

5. Retention period

5.1. Benefactors’ data is retained for as long as necessary to fulfil the purposes set out in Section 3, and for the accounting document retention periods established by the laws of Ukraine.

5.2. Where a recurring donation is set up, data is processed for its entire term and, after cancellation, within the periods set out in Clause 5.1.

5.3. Data provided for the news subscription is processed until you withdraw your consent.

6. Your rights

6.1. You have the right to: know the sources of collection and the location of your personal data; receive information on the conditions of access to it; access your data; request its rectification, erasure or restriction of processing; withdraw your consent to processing; lodge a complaint with the Ukrainian Parliament Commissioner for Human Rights.

6.2. To exercise your rights, send a request to office@yellowblue.foundation. The Fund reviews requests within 30 calendar days.

6.3. Withdrawal of consent to the processing of data necessary for a recurring donation constitutes cancellation of that donation in accordance with the Refund Policy.

7. Cookies

7.1. The Website uses cookies to ensure its operation, remember your preferences (including the selected language) and analyse traffic. You may disable cookies in your browser settings; certain features of the Website may then not work correctly.

8. Data security

8.1. The Fund applies organisational and technical measures to protect personal data against unauthorised access, loss or disclosure, including the use of a secure connection (HTTPS) and limiting access to data to authorised persons.

9. Changes to the Policy

9.1. The Fund may amend this Policy. The current version is always published on the Website. By continuing to use the Website after the changes are published, you accept the new version.
